3M Earplug Class Actions Lawsuits for Military Use

We are seeking claimants for this settlement fund regarding defective 3M Combat Arms Earplugs (Version 2 – CAEv2) that were issued or distributed to military personnel from 2003 through 2015.

Defective Design

We are working with partners on claims that 3M failed to inform the United States government about design defects in the earplugs in question.  More particularly, it is suspected that the earplugs were too short to be fully effective and leaves gaps or comes loose to allow significant amounts of sound to pass to the ear drum.  Claims also exist where the manufacturers were alleged to have known about the defect as early as the year 2000.

These ear plugs were intended to significantly reduce hearing damage from explosions, blasts, weapons fire, and aviation noise.  Varying degrees of hearing loss is suspected among expected potential claimants.

How Do I Join A 3M Ear Plug Lawsuit?

In order to join, a potential claimant should be:

  1. Diagnosed by a physician with tinnitus or hearing loss resulting in a permanent impairment rating according to standards recognized by the U.S. Department of Veteran Affairs
  2. This diagnosis must have been received near the time you were discharged from the military
  3. You must have served between the years of 2003 and 2015 and were required to use ear plugs for your job description

What Damages Can I Collect?

Any current or former military member meeting the requirements above may be able to obtain compensation for medical expenses, pain and suffering, loss of consortium, past disability, and future earning capacity loss.  Your hearing loss may be in one or both ears.

Am I Disqualified If I Am Already Receiving Disability For Hearing Loss?

No.  You are not disqualified from joining the 3M settlement fund if you are already receiving VA disability benefits for hearing loss.

What Is Happening With 3M Cases In The News?

On May 28, 2021, it was reported that 3M won a Florida trial brought by veterans against the company.  This case follows another bellwether case brought by over 230,000 claimants that was successful.  A third bellwether trial resulted in a verdict against 3M on June 18, 2021.  Other trials will be occurring at future times.  There is also a $9.1 million settlement fund.
